Underground Utilities Policy

The Underground Utilities Policy defines the responsibilities of the customer and contractor with respect to locating, identifying, and protecting underground utilities prior to and during installation. Customers accept full responsibility for disclosing private or unregistered lines on their property.

1. Public Locate Requests

US FENCE PRO LLC will submit locate requests through state-authorized systems such as “Miss Dig” or equivalent. These services mark only public utility lines and do not identify private systems such as irrigation, secondary electrical feeds, drains, or septic systems. Customers acknowledge these limitations and agree to secure additional private locating services as necessary.

2. Customer Duty to Disclose

Customers must identify and disclose all known private lines, irrigation systems, or underground structures. Failure to disclose shall result in customer liability for damages, delays, or additional costs. US FENCE PRO LLC disclaims liability for incidental damages caused by unmarked or misidentified utilities.

3. Limitation of Liability

Damages to underground systems due to inadequate disclosure or failure to hire private locate services are the sole responsibility of the customer. Consequential damages, including service interruption, emergency repairs, or loss of use, are expressly disclaimed. Disputes shall be resolved exclusively by arbitration under Michigan law, and recovery is capped at the total contract value.
