Liabilities Disclaimer
The Liabilities Disclaimer limits all financial, legal, and operational responsibility of US FENCE PRO LLC and affiliates.
1. Limitation of Recovery
Liability is capped strictly at the dollar amount paid under the specific contract. Customers may not seek damages for incidental, consequential, or punitive claims, including lost profits, diminished property value, or emotional distress.
2. Indemnification
Customers agree to indemnify and hold harmless US FENCE PRO LLC, RED HAND TECHNOLOGIES, UNITED WARRANTY COMPANY LLC, and subcontractors against third-party claims, property liens, or collection actions arising from services rendered.
3. Arbitration Enforcement
Disputes shall be resolved exclusively through binding arbitration in Macomb County, Michigan. No jury trial or class action rights are conferred. The arbitrator may award only contract remedies, never punitive damages.
4. Survival
This Disclaimer survives termination and continues indefinitely. It integrates fully with the Terms & Conditions.
