Refund Policy

1. Deposits & Earned Value

All deposits and down payments are deemed earned upon execution of a contract, estimate acceptance, or scheduling of services. Deposits compensate for administrative processing, coordination of subcontractors, preliminary design work, and procurement of materials. Customers expressly acknowledge that once materials have been ordered or crews have been scheduled, deposits are non-refundable regardless of subsequent cancellation.

2. Customer Cancellations

Cancellation by the customer after execution of an agreement does not entitle the customer to a refund, unless US FENCE PRO LLC independently determines that cancellation is warranted for extraordinary reasons. Refund requests must be submitted in writing within five (5) business days of cancellation, and approval is at the sole discretion of management. Customers remain liable for all costs incurred up to the date of cancellation, including labor, materials, fees, and subcontractor charges.

3. Company Cancellations

If US FENCE PRO LLC cancels a project for reasons not attributable to the customer, the company may issue a pro-rata refund of unearned funds. However, if cancellation results from customer breach, misrepresentation, or failure to comply with obligations (including permits or site preparation), no refund shall be due. Refunds issued will be made only through the original method of payment, less applicable processing fees or deductions for services already rendered.

4. Dispute Resolution

Refund disputes shall be submitted exclusively to binding arbitration under Michigan law. Customers waive jury trial rights and agree that remedies are limited strictly to actual unearned amounts, with no entitlement to consequential, incidental, or punitive damages. Refund obligations, if any, shall be capped at amounts directly paid under the contract in question. This Refund Policy is inseverable from the Master Terms & Conditions and must be read together with the Contracts, Estimates Disclaimer, and Sales Policy.
