This Privacy Policy describes how US FENCE PRO LLC, together with its affiliates and subcontractors, collects, uses, shares, and protects personal and business information. By engaging our services, requesting an estimate, visiting our website, or otherwise interacting with us, you agree to the terms of this Policy. It must be read as an integrated part of the Master Terms & Conditions.

1. Information Collection

US FENCE PRO LLC collects a variety of information from customers, prospective customers, suppliers, subcontractors, and site visitors. This information includes personally identifiable data such as names, addresses, phone numbers, and email addresses; business identifiers such as company names, titles, and tax records; and project-specific details such as property surveys, utility markings, photographs, and municipal permits. Information is gathered directly through estimate requests, contract forms, digital submissions, QR-coded print material, and communications over email, SMS, and telephone. Additional information may be collected from third-party sources including public property databases, credit bureaus, background check providers, and Google APIs.

Collection is performed for legitimate business purposes, including but not limited to providing accurate estimates, scheduling services, verifying property ownership, ensuring code compliance, and conducting due diligence on subcontractors and suppliers. Customers understand that by voluntarily providing information, they consent to its collection, retention, and lawful use in accordance with this Policy. Information may be retained indefinitely in secure archives to satisfy recordkeeping, insurance, or regulatory requirements. Failure to provide accurate or complete information may prevent US FENCE PRO LLC from fulfilling its contractual obligations, and customers assume the risk of delays, denials, or cancellations arising from omissions.

2. Information Use

Information collected is used exclusively for legitimate operational and contractual purposes. These purposes include preparing and delivering accurate estimates; drafting, executing, and enforcing contracts; scheduling and coordinating crews; securing permits, inspections, and bonds; and managing warranties, insurance claims, and subcontractor compliance. Information may also be used to verify creditworthiness, evaluate property conditions, detect fraud, and assess customer eligibility for financing or extended warranty programs. Customers acknowledge and agree that information is used not only to complete transactions but also to ensure compliance with municipal regulations, OSHA standards, and insurance requirements.

In addition to transactional use, data may be aggregated or anonymized for the purpose of analyzing industry trends, improving efficiency, and enhancing the quality of services provided. Aggregated data, once stripped of identifiers, may be used in marketing, reporting, or benchmarking, and customers expressly consent to this secondary use. Under no circumstances will personal information be used in a manner inconsistent with contractual obligations. All uses are considered necessary to fulfill obligations under the Master Terms & Conditions, and customers waive claims against incidental or derivative use provided such use is reasonably tied to legitimate business objectives.

3. Information Sharing

US FENCE PRO LLC shares information strictly on a need-to-know basis with trusted affiliates and third parties essential to fulfilling contractual duties. Information may be disclosed to subcontractors responsible for installation, to suppliers fulfilling material orders, to insurers and bonding agencies underwriting risk, and to municipal authorities responsible for issuing permits and conducting inspections. These disclosures are limited to what is required to complete services, and all recipients are expected to comply with confidentiality standards equivalent to those in this Policy.

Information may also be shared with affiliates including RED HAND TECHNOLOGIES, BML ENTERPRISES LLC, UNITED WARRANTY COMPANY LLC, and UNITED STATES FENCE LLC, for administrative, warranty, compliance, or technology purposes. No personal information will be sold, leased, or traded to third parties for marketing without explicit customer consent. However, customers acknowledge and agree that anonymized or aggregated data may be shared with vendors, auditors, or consultants for the purpose of improving services and systems. Disclosures may also occur when legally required, including court orders, subpoenas, or regulatory requests. Such disclosures do not constitute a breach of this Policy. By engaging services, customers expressly authorize the sharing of data in these contexts and waive claims against incidental disclosures necessary for lawful operation.

4. Data Protection

US FENCE PRO LLC employs commercially reasonable safeguards to protect information against unauthorized access, loss, misuse, or alteration. Safeguards include password-protected systems, encrypted transmissions, limited access protocols, and routine audits conducted by RED HAND TECHNOLOGIES. Information is housed on secure servers with firewall protection and intrusion monitoring. Physical records, where necessary, are stored in locked facilities with restricted access. Despite these measures, no system is entirely immune to cyberattacks, human error, or malicious activity. Customers acknowledge that absolute security cannot be guaranteed and assume the risk inherent in transmitting data electronically.

In the event of a suspected or confirmed data breach, customers will be notified as required by applicable law. Liability for breaches is expressly disclaimed to the maximum extent permitted by law and capped at the contract value for the specific services at issue. Customers are encouraged to safeguard their own records by using strong passwords, limiting unnecessary disclosures, and securing their personal devices. Data protection obligations extend beyond the term of active services, and information may remain archived for compliance and recordkeeping. By engaging services, customers agree that the data protection measures described are adequate and sufficient to meet commercial standards, and waive claims for damages arising from circumstances beyond the company’s reasonable control.

5. Customer Rights

Customers maintain certain rights concerning the collection, retention, and use of their personal data. These rights include the ability to request copies of records maintained, to correct inaccuracies, and to request restrictions on use where appropriate. All requests are subject to verification of identity, proof of contractual relationship, and compliance with ongoing obligations. While deletion requests may be made, such requests may be denied if the data is required for ongoing contracts, pending disputes, insurance purposes, or regulatory compliance. Customers acknowledge that archival records may be preserved indefinitely to protect against future claims or to document the performance of services.

Exercising rights does not eliminate the customer’s obligations under contracts or the Master Terms & Conditions. Requests must be made in writing and submitted through official company channels. US FENCE PRO LLC reserves the right to charge reasonable administrative fees for fulfilling extensive or repeated requests. Customers expressly waive the right to demand deletion of proprietary data, aggregated records, or system logs necessary for business operations. By engaging services, customers agree that their rights are limited to the extent necessary to preserve contractual integrity and operational continuity.

6. Governing Law

This Privacy Policy is governed exclusively by the laws of the State of Michigan. Any disputes arising from or relating to this Policy shall be subject to binding arbitration in Macomb County, Michigan, under the rules of the American Arbitration Association. Customers waive the right to pursue claims in civil court or to demand jury trials. The arbitrator is authorized only to award remedies consistent with the Terms & Conditions, including the Limitation of Liability clause, and has no authority to impose punitive or consequential damages beyond contract value.

This Policy is inseverable from the Master Terms & Conditions and incorporates by reference related sub-policies including the Data Policy, SMS Policy, and Marketing Policy. Customers acknowledge that Michigan law provides a fair and neutral framework for resolution and consent to its jurisdiction as a material term of engagement. All rights and obligations created by this Privacy Policy survive termination of services and bind successors, heirs, and assigns. By engaging with US FENCE PRO LLC, customers certify that they have read, understood, and agreed to the comprehensive scope of this Policy.
