Permits Policy

The Permits Policy outlines the obligations of customers regarding the acquisition of municipal permits and approvals required for fencing projects. It establishes that ultimate responsibility for legal compliance rests with the property owner unless otherwise expressly assumed by US FENCE PRO LLC.

1. Responsibility

Unless the written contract explicitly states otherwise, customers are solely responsible for obtaining all permits, licenses, or authorizations required by city, township, or county authorities. This includes zoning variances, historic district approvals, and homeowner association (HOA) permissions. US FENCE PRO LLC may provide guidance, but absence of such assistance does not transfer responsibility.

2. Consequences of Non-Compliance

Failure to secure permits may result in project delays, work stoppages, fines, or removal orders. Customers agree to indemnify US FENCE PRO LLC and affiliates against any costs, penalties, or enforcement actions arising from lack of proper permitting. Work performed without permits at customer request shall be entirely at the customer’s risk.

3. Integration

This Permits Policy works in tandem with the Permit Fees and Permit Bonds sections. Customers acknowledge that inability to obtain permits does not void financial obligations under contract. All disputes are resolved by binding arbitration in Michigan, and remedies are limited to contract value.
